If you are facing eviction due to nonpayment there are two programs available in addition to the New Mexico Home Fund. Depending on where you are in your individual eviction case, one of the two following programs will be appropriate.
To start, fill out your application for rental assistance as soon as possible. Applications are reviewed on a first-come-first-served basis.

Landlord & Tenant Mediation

If you have received a Notice to Evict due to nonpayment, the New Mexico Eviction Prevention and Diversion Program (EDP) can provide support to help keep you in your home. EPD is a no-charge mediation program involving both Landlords and Tenants to help renters access the New Mexico Home Fund to cover back rent and maintain their housing. EPD strives for the shared goals of fair compensation for the landlord and continued housing for the tenants.

Legal Representation

Legal Representation

Through a partnership with New Mexico Legal Aid (NMLA), eligible tenants facing eviction for nonpayment may receive free legal representation during their eviction process. These services are for renters who are in a formal eviction proceeding and where the landlord/tenant mediation program is not an option.

If you have received a “Notice to Evict” due to nonpayment and are already in the legal process, New Mexico Legal Aid may be able to:

  • Provide legal support to help keep you in your home
  • Provide advice, brief services (like writing a letter to your landlord)
  • Provide full representation in court to qualifying tenants so you can stay in your home or apartment
  • Help preserve housing subsidies (like Section 8 vouchers)
